Acceptable Use Policy

InstaStudio gives you powerful tools to create realistic images, video and voices. This policy sets out what you may not do with them. It forms part of our Terms of Service and applies to your prompts, uploads, outputs and how you use them — on and off our platform. The individual model providers’ usage policies also apply.
1. Principles
- Create, don’t deceive: don’t use AI media to mislead people about real events or real people.
- Consent first: only use a real person’s face, body or voice with their permission.
- Respect the law and others’ rights in India and wherever your content is published.
2. Prohibited content
You may not use the Service to generate, edit, upload, request or distribute:
- Child sexual abuse material or any sexualised depiction of minors, real or fictional, including “age-play” content or content that sexualises childlike characters. We report such content to the National Center for Missing & Exploited Children (NCMEC), Indian law-enforcement authorities and other bodies as required by law, and permanently ban the account.
- Non-consensual intimate imagery, including sexual or nude “deepfakes” of real people, “undressing” or “nudify” edits, and voyeuristic content.
- Sexually explicit content of any kind. Artistic nudity that is not sexually explicit may be allowed by some models but must never involve real, identifiable people.
- Election and civic misinformation — fabricated media of candidates, officials or election workers, fake results, content discouraging or misleading people about voting, and undisclosed synthetic political advertising, including during periods governed by the Model Code of Conduct of the Election Commission of India.
- Deceptive impersonation — content that falsely presents itself as a statement, endorsement or act of a real person, brand or public authority; fake news footage; forged documents, IDs, currency or certificates.
- Violent extremism and terrorism — praise, propaganda or recruitment for terrorist organisations, or content glorifying mass violence.
- Hate and harassment — content that attacks or dehumanises people based on religion, caste, race, ethnicity, nationality, gender, sexual orientation, disability or similar characteristics; bullying, threats, doxxing or targeted humiliation of private individuals.
- Graphic violence and self-harm — gratuitous gore, content encouraging suicide, self-harm or eating disorders.
- Illegal goods and activities — weapons manufacture, drugs, human trafficking, gambling where unlawful, or instructions for committing crimes.
- Fraud and scams — phishing material, fake product reviews or testimonials presented as genuine, investment or crypto scams, synthetic voices used to defraud (for example impersonating a relative or bank).
- Medical, legal or financial deception — fake endorsements by doctors or experts, or media designed to give false health claims.
- Any content that is unlawful under the Information Technology Act, 2000, the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Bharatiya Nyaya Sanhita, 2023, or other applicable law.
3. Real people, faces and voices
- Avatars, face swap, try-on and talking-photo features may only be used with your own likeness or with the documented, informed consent of the person depicted. Do not use these features with images or recordings of minors at all.
- Voice cloning requires that the voice is yours or that you have the speaker’s explicit permission. Do not clone the voices of celebrities, politicians or other public figures.
- Satire and commentary about public figures must be clearly identifiable as such and must not be sexual, defamatory or likely to be mistaken for real footage.
- Our Avatar agent creates original characters; do not use it to recreate a real person without consent.
4. Intellectual property
Do not upload content you don’t have rights to, or prompt for outputs that copy protected works, characters, logos or trademarks in a way that infringes others’ rights or implies false endorsement. Rights holders may report infringement to support@instadatahelp.com; we respond to valid notices and remove infringing material, and repeat infringers lose access.
5. Platform abuse
- No attempts to bypass safety filters, credit metering, rate limits or plan restrictions (including “jailbreak” prompts, prompt injection, or splitting prohibited requests across jobs).
- No creating multiple accounts to farm free credits, no reselling access or credits, and no sharing a single paid seat between people.
- No scraping, automated bulk access outside interfaces we provide, malware, or attempts to probe or disrupt our systems or other users.
- No using outputs to build a competing model-training dataset where the model’s licence prohibits it.
6. Disclosure of AI-generated content
When you publish realistic AI-generated media — especially of people, news-like events or advertising — label it as AI-generated where a reasonable viewer could be misled, and comply with the disclosure rules of the platforms you publish on and any applicable government advisories on synthetic media. Do not remove or tamper with provenance metadata or watermarks added by models.
7. Enforcement
We use automated classifiers, provider safety systems and human review. Depending on severity we may block a prompt, refuse or remove an output, disable sharing, issue a warning, suspend or permanently terminate an account without refund, and preserve and report content to law enforcement. Credits for jobs blocked by safety systems are normally refunded, but we may withhold refunds for deliberate or repeated attempts.
If you believe we made a mistake, reply to the enforcement email or write to support@instadatahelp.com — a person will review your appeal.
8. Reporting content
To report content created with InstaStudio — including a public share link — that violates this policy or your rights, email support@instadatahelp.com with the link and the reason. Requests concerning non-consensual intimate imagery or impersonation of you are prioritised and actioned within 24 hours, in line with the IT Rules, 2021.
